This document covers the Terms and Conditions for both End Users and Organizers of the EventWall platform. The End User Terms of Use can be found in Part B of this document. The Organizer Terms and Conditions can be found in Part A of this document.
Part A — Organizer Terms and Conditions
IMPORTANT NOTICE FOR CONSUMER ORGANIZERS
If you are signing up as a private individual (not in the course of a business, trade or profession), you are a CONSUMER under EU law and additional protections apply to you, clearly identified throughout this document. Please read all sections marked [CONSUMER ORGANIZERS] carefully.
1. Parties and Definitions
These Terms and Conditions ("Agreement") govern the relationship between:
EventWall Labs Limited, a company incorporated in Ireland, with registered office at 2 Lakeview, Cobh, Co. Cork, P24 WK20, Ireland, registered number 814930 ("EventWall", "we", "us", "our"); and
You, the individual or entity registering as an Organizer on the Platform ("Organizer", "you", "your").
1.1 Definitions
- "Platform" means the EventWall website, mobile applications, and related digital services operated by EventWall.
- "Event" means any event, activity, gathering or occurrence published or submitted by you on the Platform.
- "Content" means any information, data, text, images, or other material you submit, post or display on the Platform.
- "Business Organizer" means an Organizer acting in the course of a business, trade or profession.
- "Consumer Organizer" means an Organizer who is a natural person acting outside the course of a business, trade or profession.
- "Subscription" means the paid plan selected by you to access Organizer features on the Platform.
- "End Users" means members of the public who access and view event information on the Platform.
2. Nature of the Platform
EventWall operates as an event aggregation and publication platform. We:
- Gather publicly available event data from third-party sources;
- Allow Organizers to submit and publish their own event listings;
- Make event information available to End Users free of charge;
- Act as an information service provider, not as an event organiser, ticket agent, or promoter.
EventWall does not verify the accuracy of submitted event information and is not responsible for the actual organisation, cancellation or modification of any event listed on the Platform.
3. Account Registration
3.1 Eligibility
To register as an Organizer you must be at least 18 years of age, or if a Business Organizer, have authority to bind the entity you represent.
3.2 Account Information
You agree to provide accurate, current and complete information at registration and to maintain and update such information. You are responsible for maintaining the confidentiality of your account credentials.
3.3 Business or Consumer Status
During registration you must identify whether you are a Business Organizer or a Consumer Organizer. This classification determines the legal protections applicable to your use of the Platform. If your status changes, you must update your account accordingly.
4. Subscription Plans, Additional Fees and Promotional Packages
4.1 Monthly Subscription
Access to Organizer features on the Platform requires a paid monthly Subscription. The Subscription entitles you to:
- Publication of up to five (5) Events during the 30-day period commencing on the date your Subscription starts or renews ("Subscription Period");
- Access to your Organizer dashboard and account management tools;
- Standard listing visibility for all published Events.
The monthly Subscription fee is set out on our Pricing page at eventwall.app and is charged in advance at the start of each 30-day Subscription Period. Unused Event slots do not carry over to the next Subscription Period.
4.2 Additional Event Fee
If you wish to publish more than five (5) Events during any Subscription Period, an additional fee per Event will apply for each Event posted beyond the five included in your Subscription. The per-event additional fee is set out on our Pricing page at eventwall.app.
Additional event fees are charged at the time of publication of the additional Event and are non-refundable once the Event has been published, except as set out in Section 5.
4.3 Promotional Highlight Package
EventWall offers an optional Promotional Highlight Package, which provides featured placement of your selected Event in a rotating carousel displayed at the top of the Platform's listings for one (1) specific geographic location of your choice.
The carousel operates as follows:
- Your Event will be included in the featured carousel alongside up to four (4) other promoted Events, for a maximum of five (5) Events displayed in the carousel at any one time for that location;
- Carousel placement is available on both the EventWall app and website;
- The Package runs for thirty (30) consecutive calendar days from the activation date;
- Carousel position within the five slots is rotated automatically and is not guaranteed to be a fixed position.
Purchasing the Promotional Highlight Package does not guarantee exclusive top placement. Visibility depends on how many other Organizers have purchased carousel placement for the same location during the same period. EventWall reserves the right to limit carousel availability per location to a maximum of five (5) concurrent promoted Events.
The Promotional Highlight Package is priced at a fixed fee per Event per location per 30-day period, as set out on our Pricing page at eventwall.app. The Package may be purchased independently of or in addition to your monthly Subscription.
The Promotional Highlight Package is a distinct, time-limited digital service. Once activated, the Package begins immediately and is non-refundable, except as set out in Section 5.
4.4 Payment
- All fees are charged in advance via the payment method registered to your account.
- Payment is processed through our third-party payment provider. By subscribing or purchasing any fee-based service, you authorise us to charge your chosen payment method.
- All prices are exclusive of VAT unless otherwise stated. VAT will be applied at the rate applicable in your jurisdiction.
- Business Organizers with a valid EU VAT number may be eligible for VAT reverse charge treatment on B2B transactions. You are responsible for providing accurate VAT information.
4.5 Auto-Renewal
YOUR MONTHLY SUBSCRIPTION WILL AUTOMATICALLY RENEW every 30 days from your subscription start date unless you cancel before the renewal date. You may cancel auto-renewal at any time through your account settings. Promotional Highlight Packages and additional event fees do not auto-renew.
4.6 Price Changes
We may change our fees at any time. For Business Organizers, we will provide at least 15 days written notice of any fee changes, as required by Regulation (EU) 2019/1150, and you may terminate your Subscription before the new pricing takes effect. For Consumer Organizers, we will provide at least 30 days notice and obtain your renewed consent where required by applicable law.
5. Cancellation, Refunds and Right of Withdrawal
5.1 Right of Withdrawal [CONSUMER ORGANIZERS ONLY]
If you are a Consumer Organizer, you have the right to withdraw from this Agreement within 14 calendar days of the date your Subscription begins, without giving any reason, pursuant to Directive 2011/83/EU as implemented in Ireland by the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.
5.2 Waiver of Right of Withdrawal Upon Posting an Event
IMPORTANT: By publishing your first Event on the Platform during the 14-day withdrawal period, you expressly acknowledge and agree that:
- You are requesting that EventWall begin providing the digital service immediately and in full;
- You understand that, once you have posted an Event, the service has been partially performed at your express request;
- You thereby waive your right of withdrawal in respect of the monthly Subscription fee for that billing period.
This waiver applies specifically to the monthly Subscription fee. It does not affect any other statutory rights you may have under applicable consumer protection law.
If you subscribe but do not post any Event during the 14-day withdrawal period, your right of withdrawal remains intact and you may exercise it as set out in Section 5.3.
5.3 How to Exercise Your Right of Withdrawal
To exercise your right of withdrawal (where it has not been waived under Section 5.2), you must contact us by email at info@eventwall.app before the 14-day period expires. Your email must clearly state your intention to withdraw and include your account details. We will acknowledge your request within 5 business days.
If withdrawal is valid, we will reimburse all Subscription fees paid for that billing period without undue delay and no later than 30 days from the date we receive your withdrawal notice, using the same payment method as your original transaction.
5.4 Refunds Outside the Withdrawal Period
Outside the 14-day withdrawal period, the following refund rules apply:
- Monthly Subscription fees: non-refundable once the billing period has begun. You may cancel at any time to prevent future renewals, but no partial refund is issued for the remaining days in a billing month.
- Additional event fees: non-refundable once an Event has been published on the Platform.
- Promotional Highlight Package: non-refundable once the Package has been activated, as this is a time-limited digital service that commences immediately upon purchase.
5.5 Refund Process
All refund requests must be submitted by email to info@eventwall.app. Requests submitted through any other channel (including social media, live chat or telephone) will not be processed. Please include your account name, the specific fee you are requesting a refund for, and the reason for your request. We aim to respond to all refund requests within 5 business days.
5.6 Cancellation of Subscription
You may cancel your Subscription at any time through your account settings. Cancellation takes effect at the end of the current 30-day Subscription Period. You will retain access to your Subscription features, including your five included Event slots, until the end of that period. No refund is issued for the remaining days, except as set out above.
6. Content and Intellectual Property
6.1 Your Content Licence
By submitting Content to the Platform, you grant EventWall a non-exclusive, worldwide, royalty-free, transferable licence to use, reproduce, distribute, display, and make available your Content for the purpose of operating the Platform and providing services to End Users. This licence continues for the duration of the Agreement and, to the extent necessary to retain event information already published to End Users, for a reasonable period thereafter.
6.2 Your Warranties
You warrant that:
- You own or have the necessary rights to all Content you submit;
- Your Content does not infringe any third-party intellectual property rights;
- Your Content is accurate and not misleading;
- Your Content complies with all applicable laws.
6.3 EventWall Intellectual Property
The Platform, including its design, software, databases, and aggregated data, are protected by copyright and database rights under Directive 96/9/EC and Directive 2019/790/EU. You may not copy, extract, reproduce or republish any substantial part of the Platform or its data without our express written consent.
6.4 Content Removal
We reserve the right to remove any Content that we reasonably believe violates these Terms, applicable law, or the rights of third parties. Where possible, we will notify you before removal and give you an opportunity to respond.
7. Organizer Obligations
You agree to:
- Provide accurate, truthful and up-to-date event information;
- Not submit Content that is false, misleading, defamatory, discriminatory, or promotes illegal activities;
- Not use the Platform to scrape, harvest or extract data for competing services;
- Not use automated tools to access or interact with the Platform without our prior written consent;
- Comply with all applicable laws, including consumer protection, data protection, and event safety regulations;
- Promptly update or remove event listings when events are cancelled, postponed or materially changed.
8. Platform-to-Business Obligations [BUSINESS ORGANIZERS ONLY]
The following applies to Business Organizers pursuant to Regulation (EU) 2019/1150:
8.1 Ranking
Event listings on the Platform may be ranked or ordered. The main parameters determining ranking are: date, relevance, category, subscription tier. We will update this information if our ranking criteria change.
8.2 Changes to Terms
We will provide Business Organizers with at least 15 days written notice before implementing any changes to these Terms. You may terminate the Agreement before the changes take effect.
8.3 Complaints
Business Organizers may submit complaints regarding our services to info@eventwall.app. We will acknowledge complaints within 5 business days and aim to resolve them within 30 days.
9. Data Protection
EventWall processes personal data in accordance with Regulation (EU) 2016/679 (GDPR), the Irish Data Protection Acts 2018, and our Privacy Policy available at [URL].
Our supervisory authority is the Data Protection Commission (DPC) of Ireland (www.dataprotection.ie). Organizers based in Spain may also contact the Agencia Española de Protección de Datos (AEPD) (www.aepd.es) with concerns relating to processing in Spain.
By registering as an Organizer, you confirm that you have the necessary lawful basis to share any personal data of third parties contained in your event listings with us.
10. Disclaimers and Limitation of Liability
IMPORTANT — PLEASE READ THIS SECTION CAREFULLY. IT SETS OUT THE BASIS ON WHICH EVENTWALL LIMITS ITS LIABILITY TO YOU AND TO END USERS IN RESPECT OF EVENTS LISTED ON THE PLATFORM.
10.1 EventWall is a Publishing Platform Only
EventWall is an event aggregation and publication platform. We are not the organiser, promoter, operator or owner of any event listed on the Platform, whether submitted by an Organizer or aggregated from public third-party sources. We have no control over the organisation, management, safety, quality or conduct of any event. However, EventWall may from time to time organise and publish its own branded events on the Platform. Where an event is organised directly by EventWall, this will be clearly indicated in the event listing. Where an event is organised directly by EventWall, EventWall accepts responsibility as event organiser to the extent provided by applicable law.
10.2 No Liability for Event Inaccuracies
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVENTWALL EXPRESSLY EXCLUDES ALL LIABILITY FOR ANY LOSS, DAMAGE, COST OR INCONVENIENCE ARISING FROM:
- Inaccurate, incomplete, outdated or misleading event information, including incorrect dates, times, venues, prices, descriptions or entry requirements, whether submitted by an Organizer or aggregated from a third-party source;
- Cancellation of an event by the Organizer or any third party, for any reason whatsoever;
- Postponement, rescheduling or change of date of an event;
- Change of venue or location of an event;
- Modification of the nature, content, lineup, programme or any other material aspect of an event;
- An event not taking place as advertised, for any reason;
- The Organizer's failure to update or remove a listing after an event has been cancelled, postponed or materially changed;
- Errors or omissions in event information aggregated from public third-party sources over which EventWall has no editorial control.
10.3 Organizer Responsibility for Event Information
As an Organizer, you are solely and exclusively responsible for:
- The accuracy, completeness and currency of all event information you submit to the Platform;
- Promptly updating your event listing if any details change, including cancellation, postponement, venue change or any other material modification;
- Promptly removing your event listing from the Platform if the event is cancelled and will not be rescheduled;
- Any claims, losses or complaints brought by End Users or third parties arising from inaccurate or outdated event information you have submitted;
- Compliance with all applicable laws governing the organisation and promotion of your event.
EventWall shall have no liability to you or to any End User or third party for losses arising from your failure to fulfil these obligations.
10.4 No Liability for Third-Party Aggregated Data
The Platform displays event information collected from publicly available third-party sources. EventWall does not verify, endorse or guarantee the accuracy of such information. We expressly disclaim all liability for any loss or damage arising from reliance on aggregated third-party event data, including but not limited to events that do not take place, have been cancelled, or differ materially from how they are described in the source data.
10.5 Platform Availability
The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free or free from viruses or other harmful components. We are not liable for any loss arising from unavailability of the Platform, including inability to publish or update event listings.
10.6 Limitation of Liability
To the maximum extent permitted by applicable law, EventWall's total aggregate liability to Business Organizers for all claims arising out of or in connection with this Agreement, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the total Subscription fees paid by you in the 12 months immediately preceding the event giving rise to the claim.
EventWall shall not be liable to Business Organizers for any indirect, consequential, special, incidental or punitive loss or damage, including loss of profits, loss of revenue, loss of business, loss of data, or damage to reputation, even if advised of the possibility of such loss.
10.7 Consumer Organizers — Statutory Rights Preserved
If you are a Consumer Organizer, nothing in this Section 10 limits or excludes EventWall's liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable Irish or EU consumer protection law. Your statutory rights as a consumer are not affected by these Terms.
11. Cancellation and Termination
11.1 Cancellation by You
You may cancel your Subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. No refund is provided for unused portions of a billing period, except for Consumer Organizers exercising the right of withdrawal under Section 5.
11.2 Termination by EventWall
We may suspend or terminate your account with immediate effect if you materially breach these Terms, or with 30 days notice for any other reason. For Business Organizers, we will provide at least 30 days notice of termination unless termination is due to a serious breach.
11.3 Effect of Termination
Upon termination, your access to the Platform will cease. We may retain your event data for a period of up to 36 months to allow End Users to access historical event information, after which it will be deleted in accordance with our data retention policy.
12. Governing Law and Dispute Resolution
12.1 Governing Law
This Agreement is governed by the laws of Ireland. However, if you are a Consumer Organizer resident in another EU member state, you will also benefit from the mandatory consumer protection provisions of the law of your country of residence.
12.2 Jurisdiction
Disputes shall be subject to the non-exclusive jurisdiction of the Irish courts. Consumer Organizers may also bring proceedings in the courts of their country of residence.
12.3 Online Dispute Resolution
If you are a Consumer Organizer, you may use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes: https://ec.europa.eu/consumers/odr

13. General
13.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and EventWall regarding your use of the Platform as an Organizer.
13.2 Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Part B — End User Terms of Use
1. Introduction and Acceptance
These Terms of Use ("Terms") govern your access to and use of the EventWall platform, website and related services ("Platform") operated by EventWall Labs Limited, a company incorporated in Ireland ("EventWall", "we", "us").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
These Terms are governed by Irish law, the laws of the European Union, and where you are located in Spain, by applicable Spanish law including the Ley de Servicios de la Sociedad de la Información (LSSI) and the Ley General para la Defensa de los Consumidores y Usuarios (LGDCU).
2. What EventWall Does
EventWall is an event aggregation and discovery platform. We:
- Collect and display publicly available event information from various sources;
- Allow event organizers ("Organizers") to publish their own event listings;
- Make this information freely accessible to you as an End User.
EventWall acts as an information intermediary in respect of events listed by third-party Organizers and aggregated from public sources. We are not the organiser, promoter or operator of such third-party events and we do not sell tickets, manage bookings or take responsibility for their operations. However, EventWall may from time to time organise and publish its own branded events on the Platform. Where an event is organised directly by EventWall, this will be clearly indicated in the event listing. Where an event is organised directly by EventWall, EventWall accepts responsibility as event organiser to the extent provided by applicable law.
3. Important Disclaimer — Please Read
EVENTWALL IS AN INFORMATION PLATFORM IN RESPECT OF THIRD-PARTY EVENTS. WE ARE NOT THE ORGANISER OF THIRD-PARTY EVENTS LISTED ON THE PLATFORM. WE DO NOT VERIFY THIRD-PARTY EVENT INFORMATION AND WE ARE NOT LIABLE FOR CANCELLED, POSTPONED, INACCURATE OR MISLEADING THIRD-PARTY EVENT LISTINGS. WHERE AN EVENT IS ORGANISED DIRECTLY BY EVENTWALL, THIS WILL BE CLEARLY INDICATED IN THE LISTING.
3.1 No Liability for Event Cancellation or Changes
EventWall expressly excludes, to the maximum extent permitted by applicable law, all liability for any loss, cost, damage or inconvenience you suffer as a result of:
- An event being cancelled, called off or abandoned, for any reason, by the Organizer or any third party;
- An event being postponed, rescheduled or moved to a different date;
- A change of venue, location or address for an event;
- A modification to the nature, content, programme, lineup or any other material aspect of an event;
- An event not taking place as described in the listing, for any reason;
- The Organizer failing to update or remove a listing after cancellation, postponement or a material change;
- Inaccurate, incomplete, outdated or misleading event information submitted by an Organizer;
- Errors or omissions in event data collected from public third-party sources.
3.2 No Liability for Consequential Losses
Without limiting the above, EventWall is not liable for any costs or losses you incur in connection with attending or planning to attend an event listed on the Platform, including but not limited to: travel costs, accommodation costs, ticket or booking fees paid to third parties, time off work, or any other expenditure made in reliance on information displayed on the Platform.
3.3 Your Responsibility to Verify
Before travelling to, booking for, or making any expenditure in connection with an event found on the Platform, you are strongly advised to independently verify directly with the Organizer or the Venue where the event takes place:
- That the event is confirmed and taking place as listed;
- The correct date, time, and venue;
- Any ticket, registration or entry requirements;
- Any age restrictions, safety requirements or access conditions.
EventWall accepts no responsibility for losses arising from your failure to verify event details independently.
4. Your Use of the Platform
4.1 Permitted Use
You may use the Platform to search for, view and share event information for personal, non-commercial purposes.
4.2 Prohibited Use
You must not:
- Use automated tools, bots or scrapers to access or extract data from the Platform;
- Reproduce, republish or redistribute substantial portions of the Platform's content or database for commercial purposes;
- Use the Platform to harass, defame or harm other users or Organizers;
- Attempt to gain unauthorised access to the Platform's systems or data;
- Use the Platform in any way that violates applicable law.
The Platform and its databases are protected by copyright and database rights under Directive 96/9/EC, Directive 2019/790/EU and the Irish Copyright and Related Rights Act 2000. Unauthorised extraction or reuse of substantial parts of the database is prohibited.
5. Third-Party Content and Links
The Platform contains content submitted by Organizers and aggregated from third-party sources. EventWall does not endorse, verify or take responsibility for such third-party content.
The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices or terms of such websites.
As a hosting provider under the Digital Services Act (Regulation (EU) 2022/2065), EventWall has put in place a notice and action mechanism for reporting unlawful content. To report content you believe to be unlawful, please contact: info@eventwall.app
6. Intellectual Property
All intellectual property rights in the Platform, including its design, software, databases, and any original content created by EventWall, are owned by or licensed to EventWall Labs Limited.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes only.
7. Data Protection and Privacy
EventWall processes personal data in accordance with GDPR (Regulation (EU) 2016/679), the Irish Data Protection Acts 2018, and in Spain, the Ley Orgánica 3/2018 (LOPDGDD).
Details of how we collect, use and protect your personal data are set out in our Privacy Policy available at eventwall.app
Our data protection supervisory authority is the Data Protection Commission (DPC), Ireland (www.dataprotection.ie). Users in Spain may also contact the Agencia Española de Protección de Datos (AEPD) (www.aepd.es).
8. Limitation of Liability
8.1 Platform Provided As Is
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, EventWall makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy or availability.
8.2 Exclusion of Event-Related Liability
As set out in full in Section 3, EventWall expressly excludes all liability for loss or damage arising from event cancellations, postponements, venue changes, inaccurate event information, or any failure of an event to take place as described. This exclusion applies regardless of whether the information was submitted by an Organizer or aggregated from a third-party source.
8.3 Exclusion of Indirect Loss
EventWall is not liable for any indirect, consequential, special, incidental or punitive loss arising from your use of or inability to use the Platform, including loss of profits, loss of data, or loss of opportunity, even if EventWall has been advised of the possibility of such loss.
8.4 Liability Cap
To the maximum extent permitted by applicable law, EventWall's total aggregate liability to you for all claims arising from your use of the Platform shall not exceed EUR 100.
8.5 Statutory Rights Preserved
Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, or our liability for fraudulent misrepresentation, or any other liability which cannot be limited or excluded by applicable law.
9. Consumer Rights
If you are a consumer in the EU, your mandatory consumer protection rights under the laws of your country of residence are not affected by these Terms. For unresolved disputes you may contact the European Consumer Centres Network (ECC-Net) at https://consumer-redress.ec.europa.eu, or the relevant national consumer authority in your country of residence.
10. Changes to These Terms
We may update these Terms at any time. The updated Terms will be posted on the Platform with the date of the last revision. Continued use of the Platform after the updated Terms are posted constitutes your acceptance of the changes.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland and any disputes shall be subject to the jurisdiction of the Irish courts.
